BOMBAY HIGH COURT RULED THAT PARENTS CAN TAKE BACK PROPERTY GIFTED TO THEIR SON IF HE ILL-TREATS THEM

The Bombay High Court ruled that the elderly parents can take back a share in their property given to a son as a gift if he fails to look after them or harasses them. Citing the special law for the maintenance of senior citizens, the court upheld a tribunal’s order that had cancelled a gift deed given by an elderly resident by which he had granted 50% share in his flat to his son. The Maintenance and Welfare of Parents and Senior Citizens Act, 2007, has a provision to protect vulnerable parents and elderly people, who they gift assets so that the person would take care of them.

SON HAS NO LEGAL RIGHT TO STAY IN HOME WHICH WAS SELF-EARNED BY HIS PARENTS: DELHI HIGH COURT

The Delhi High Court ruled that the son has no legal right to stay at home where parents have earned themselves. If the son was allowed to stay at home at the time of good relations, it doesn’t mean that they want to carry the burden of that son’s life. He can live in the house as long as his parents permit him to stay in home. The verdict was observed while dismissing a plea filed by a son against lower court order that allows parents to evacuate their son and daughter-in-law from their self-earned home.

BOMBAY HIGH COURT PULLED UP WOMAN, KIDS FOR DRAGGING ELDERLY RELATIVES TO COURT FOR PROPERTY

The Bombay High Court directed a woman and her children to withdraw domestic violence proceedings by July 3 against her octogenarian sister-in-law and 78-year-old brother-in-law. The woman and her children have moved the court for partitioning a ground-plus-two-storey bungalow in Mulund. She alleged that her late husband’s sister and brother were “unlawfully restraining” her and preventing her children from having unbridled access to her at the bungalow. The High Court sought replies but set no deadline due to their health, vacated interim relief granted earlier in favour of the plaintiff and posted the matter for hearing in due course.

GRANDSON AND HIS WIFE PENALIZED FOR HARASSING HIS GRANDMOTHER AND CAUSING HER MENTAL AGONY

A city court in Mumbai has ruled in favour of a 92-year-old Worli resident, in a domestic violence case, who moved the court against her grand-daughter-in-law and grandson for continuously threatening to send her to an old-age home and subjecting her to other forms of mental torture. The court, while restraining the young couple from mentally harassing and humiliating the nonagenarian, also ordered them to pay her Rs. 50,000 as compensation for causing her mental agony. However, the court did not agree with the woman’s plea to make the young couple, a businessman and an accountant, vacate the home owned by her.

NRI MARRIAGES NEED TO BE REGISTERED WITHIN 7 DAYS: MINISTRY OF WOMEN AND CHILD DEVELOPMENT

All NRI marriages honoured in India would need to be registered within seven days, said by the Union ministry of women and child development. If the NRI marriages are not registered within seven days, the passports and visas would not be issued. The decision for mandatory registration of marriages within seven days was taken after a group of ministers met to map out legal solutions for redressing the issues faced by women in NRI marriages.

SCHOOL CAN’T SEND CHILDREN OUT OF CLASSROOM, DIRECTOR AND PRINCIPAL CONVICTED BY A DELHI COURT

A Delhi Court has convicted the director and Principal of a school on the charges of causing mental trauma to a seven-year-old student for not allowing her to enter the classroom. They were given a two-month jail term for the misconduct towards the child, which is a crime according to the Juvenile Justice (Care and Protection) Act, and also slapped a fine of Rs 2.5 lakh each to the Director and Principal of the school.

ALL NRI MARRIAGES TO BE REGISTERED WITHIN 48 HOURS, ELSE PASSPORT, VISA COULD BE REVOKED: MINISTRY OF WOMEN AND CHILD DEVELOPMENT

Maneka Gandhi, the Minister of Women and Child Development (WCD) said that all NRI marriages honoured in India would have to be registered within 48 hours, else the passport and visas would be revoked or not issued. This development comes amid an increased instance of look-out notices being issued against Non-Resident Indians (NRIs) abandoning their wives in India. The WCD Ministry is in the process of issuing orders to the registrars that details of such marriages should be provided to it so that a central database can be maintained.
