BOMBAY HIGH COURT SEEK REPLY FROM BMC ON SINGLE MOTHER’S PLEA REGARDING TEST TUBE BABY’S BIRTH CERTIFICATE

The Bombay High Court asked the Brihanmumbai Municipal Corporation (BMC) to reply to an application filed by a 31-year-old woman seeking that she must not be compelled by BMC to record the name of her daughter’s biological father on the birth certificate. The unmarried woman had conceived via artificial insemination (test tube) in 2016 and hence she wants the father’s column to remain blank.

DO NOT BECOME CONSCIENCE KEEPERS: SUPREME COURT TOLD KHAPS

The Supreme Court told khap panchayats not to act as conscience keeper of the people and said that no third person should interfere in the choice of marriage between two adults, and the bench also said that whether the law prohibits or allows a particular marriage, the law will take its own course” but when two people get into a wedlock, no panchayat, no one should interfere, and asked the Centre to step in to protect such couples from khaps.

ATTACKS ON COUPLES BY KHAP PANCHAYATS ABSOLUTELY ILLEGAL: SUPREME COURT

The Supreme Court declared it was illegal for parents or khap panchayats to interfere in decisions of adult men and women of different castes to marry. “Any adult man or woman can marry anyone of their own choice. No parents, no society or khap panchayat can stop them.” said Chief Justice Dipak Misra. The court asked the centre to respond to suggestions submitted earlier by amicus curiae (friend of the court) Raju Ramchandran on measures to prevent harassment and honour killing of young couples opting for inter-caste and intra-clan (gotra) marriages.

SONS AND DAUGHTERS WHO DID NOT TAKE CARE OF THEIR PARENTS WILL BE PUNISHED

In a press meet IKASA Co-Convener Mr. Puligari Govardhan Reddy said that sons and daughters who leave their parents without humanity are liable for punishment. As per law, sons and daughters who did not take care of their parents or who leave their parents in old age homes will face a fine of Rs. 5000 and a jail term of 3 months.

NO LAW SAID THAT WOMAN HAVE TO CHANGE HER RELIGION AFTER MARRIAGE: SUPREME COURT

While dealing with a legal question whether a Parsi woman loses her religious identity if she marries a man from a different religion, a five-judge Constitution Bench of the Supreme Court said that no provision in the law states that a woman will have to merge her religion with her husband’s after an inter-religion marriage, and asked advocate Gopal Subramanium, representing ‘Valsad Parsi Trust’, to take instruction and apprise it on December 14 as to whether it can allow Goolrokh M Gupta, a Parsi woman who had married a Hindu, to attend the last rites of her parents.

NRIs MOVED SUPREME COURT FOR LAW TO DEAL WITH PARENTAL ABDUCTION CASES

The Supreme Court asked the Centre to frame a law to deal with cases related to parental abduction, under which a parent living in a foreign country takes back the child to India without informing his or her spouse. The Supreme Court issued this notice after NRIs approached the court.
